These Terms of Service (the “Terms”) govern your access to and use of kopakick.com (the “Site”) and any purchases made through it. By using the Site or placing an order, you agree to these Terms. Please read them carefully.
1. About us:
KOPAKICK is the brand operating the online store at kopakick.com. References in these Terms to “we”, “us”, or “our” are to Kopakick. References to “you” are to the user of the Site or the customer placing an order.
2. Eligibility:
You must be at least 16 years old to use this Site, or have the consent of a parent or legal guardian. By placing an order, you confirm that you are legally capable of entering into a binding contract.
3. Products and pricing:
Prices are listed in Euros (EUR) by default. We may also display equivalent prices in your local currency, based on current exchange rates. The amount actually charged is the EUR price unless your local checkout converts it at the time of purchase, in which case the converted amount is shown before you confirm.
Some products are limited in stock or limited-edition. Stock and prices may change without notice.
Product images on the Site are illustrative only. The actual product you receive may look slightly different from the photos. Logo placement may differ, the logo may be in a different position than shown, the logo may be smaller or larger, or in some cases the product may ship without a visible logo at all. Colour shade, label design, stitching details, and other cosmetic elements may also vary slightly between batches. The functionality, performance, and intended use of the product remain the same as described on the product page.
Packaging may also vary. During high-volume periods, sales, or peak season, we sometimes switch to plain or simplified packaging to keep dispatch times fast and get orders to customers without delay. This does not affect the product itself.
4. Orders:
Placing an order is an offer to buy. The contract of sale is formed only when we send you an order-confirmation email. We reserve the right to refuse or cancel any order, including, but not limited to, cases of suspected fraud, pricing errors, or stock unavailability. If we cancel a paid order, you receive a full refund.
5. Payment:
Payment is taken at checkout via the methods displayed on our checkout page. We use secure third-party payment processors and don’t see or store your card details on our servers.
6. Shipping:
Shipping terms, timeframes, and costs are described in our Shipping Policy, which forms part of these Terms. We currently offer free shipping worldwide, with delivery in 4 to 7 working days from dispatch.
Risk of loss passes to you on delivery; title to the goods passes to you on full payment.
7. Returns and refunds:
Your rights to return items, request a refund, or exchange products are described in our Refund Policy. Note that opened, unsealed, or used products cannot be returned. Nothing in these Terms limits your statutory rights as a consumer under EU law.
8. Right of withdrawal (EU consumers):
If you’re a consumer based in the EU, you have the right to withdraw from your purchase contract within 14 days of receiving the goods, without giving any reason. To exercise this right, email us at help@kopakick.com with your order details before the 14 days are up. After we acknowledge the withdrawal, follow the process in our Refund Policy.
9. Intellectual property:
All content on kopakick.com, the Kopakick name, logo, product photography, copy, illustrations, and design, is owned by Kopakick or its licensors and is protected by copyright, trademark, and other intellectual-property laws. You may not copy, reproduce, modify, or distribute any part of the Site for commercial use without our prior written permission.
10. Acceptable use:
You agree not to use the Site to:
- Break any applicable law or regulation
- Infringe anyone’s intellectual-property or other rights
- Upload viruses, malware, or anything else harmful
- Attempt to access areas of the Site you’re not authorised to access
- Interfere with or disrupt the Site or its underlying infrastructure
11. Disclaimers:
We make every reasonable effort to keep the Site running smoothly and the information on it accurate, but the Site is provided “as is”. We don’t guarantee uninterrupted availability, error-free operation, or that the content is completely free of typos or omissions.
Kopakick products are intended for amateur and recreational football use unless otherwise stated. Always train and play responsibly, no piece of equipment can prevent every injury.
12. Limitation of liability:
To the maximum extent permitted by law, our total liability to you for any claim arising out of or relating to these Terms or your use of the Site is limited to the amount you paid for the order in question. We aren’t liable for indirect, incidental, or consequential damages, lost profits, or loss of data. Nothing in these Terms excludes liability that can’t lawfully be excluded, including liability for fraud, gross negligence, or death or personal injury caused by negligence.
13. Force majeure:
We aren’t liable for delays or failures in performance caused by events outside our reasonable control, including natural disasters, acts of war, civil unrest, strikes, supplier failures, internet or carrier outages, or government measures.
14. Changes to these Terms:
We may update these Terms from time to time. The latest version is always posted on this page, with the date last updated. Continued use of the Site after changes are posted means you accept the updated Terms. If a change materially affects your rights, we’ll do our best to notify you in advance.
15. Governing law and disputes:
These Terms are governed by EU consumer-protection law and, where applicable, the laws of the country in which you live. Disputes will be handled by the competent courts of your country of residence, subject to your statutory rights as a consumer.
EU consumers can also submit disputes through the European Commission’s Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
